Yes — UK landlords are legally required to provide smoke alarms in rented properties. But the specifics depend on the type of tenancy and property. Here's what the law actually says.
The Law: Smoke and Carbon Monoxide Alarm Regulations
The Smoke and Carbon Monoxide Alarm (Amendment) Regulations 2022 require all private landlords in England to:
- Install at least one smoke alarm on every storey of a property used as living accommodation
- Install a carbon monoxide alarm in any room with a fixed combustion appliance (boiler, gas fire, solid fuel burner) — excluding gas cookers
- Ensure all alarms are in working order at the start of each new tenancy
- Repair or replace any alarm that a tenant reports as faulty
What About HMOs?
Houses in Multiple Occupation are subject to stricter requirements. HMO landlords must provide a full interlinked fire detection system — typically Grade D, Category LD2 under BS 5839 Part 6 — covering all escape routes, bedrooms, kitchens, and living rooms.
Local councils have licensing powers over HMOs and can impose additional conditions. Non-compliance can result in fines of up to £30,000 and, in serious cases, criminal prosecution.
What Are the Penalties for Non-Compliance?
If a landlord fails to install smoke alarms as required, the local authority can issue a remedial notice. If the landlord doesn't comply within 28 days, the council can arrange for the alarms to be fitted and charge the landlord up to £5,000.
For HMO licensing violations, fines can reach £30,000 per offence. Beyond financial penalties, failure to maintain adequate fire detection can expose landlords to serious civil and criminal liability if a tenant is injured or killed in a fire.
What Type of Smoke Alarm Should a Landlord Install?
For single-let properties, a mains-powered interlinked optical smoke detector on each floor is the recommended standard. Battery-only alarms are permitted but less reliable — batteries fail, and tenants don't always replace them.
For HMOs, standalone battery alarms are not sufficient. You need Grade D mains-powered interlinked alarms with battery backup, positioned to meet Category LD2 requirements.
